1. Contract Conclusion

·       These General Terms and Conditions (hereinafter referred to as "GTC") of solunma.com (hereinafter referred to as " SOLUNMA ") apply to all processing and handling of orders from their customers (hereinafter referred to as "Customers" or "You") in online shops operated by SOLUNMA.

·       The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. By clicking the "Order Now" button, you place a binding order for the goods contained in your shopping cart. Confirmation of the receipt of the order follows immediately after submitting the order. A binding contract is concluded upon receipt of the order confirmation.

2. Voluntary Return Policy / Right of Withdrawal

·        We grant you a voluntary return guarantee of a total of 10 days from receipt of the goods, with the exception of discounted items, e-books, and hygiene items (e.g., underwear), for which no return right exists. If a return right applies, you can withdraw from the contract by informing us of the withdrawal within 10 days of receiving the goods and returning the goods within 10 days after declaring the withdrawal, provided the goods are complete, in their original packaging, and in an unused and undamaged condition. Timely dispatch is sufficient to meet the deadline.

·        Send the goods back in their original packaging, including all accessories and packaging components, to the address provided to you via email.

3. Delivery

·        Deliveries are generally only possible within Switzerland. Delivery is usually carried out by Post CH AG. The dispatch of items is only done in household quantities and exclusively to end consumers.

·        Please note that we are exceptionally not obliged to deliver the ordered goods if we have properly ordered the goods on our part but have not received the correct or timely delivery. The prerequisite is that we are not responsible for the unavailability of the goods and that we inform you of this circumstance without delay. In the event of a subsequent unavailability of the goods, any payments already made by you will be refunded immediately.

·        If deadlines are stated in business days, this refers to all days from Monday to Friday, excluding public holidays.

·        We reserve the right to refuse or cancel an order if the order was generated by software, a machine, a crawler, a spider, or through other automated web programs or scripted behavior systems, or by utilizing third-party services that place orders on your behalf.

4. Prices and Payment

·        We cover the shipping costs for you.

·        Prices include the statutory value-added tax.

·        Payment is generally to be made by credit card, Twint, or PayPal (for instant transfers, see the following section). You pay directly during the ordering process by entering your payment details. After completing the order process, your chosen payment method will be charged with the actual invoice amount after deducting any applicable discounts, etc.

·        You also have the option to pay via instant bank transfer (Sofortüberweisung). If you choose this payment method, you will receive an invoice for the instant transfer after completing the order process.

·        The goods will be shipped upon receipt of payment.

·        You agree to receive invoices, credit notes, etc., either electronically or in paper form.

5. Customs

The items are delivered directly to you from SOLUNMA partners abroad. Customers are responsible for complying with import and customs regulations. Any resulting costs and fees are to be borne by the customer.

6. Warranty

The statutory warranty for defects applies. SOLUNMA expressly reserves the right to provide a defect-free replacement for goods with reported and verified defects.

7. Liability Disclaimer

·        SOLUNMA 's contractual and non-contractual liability towards the customer is excluded to the extent permitted by law, except for damages caused intentionally or through gross negligence.

·        SOLUNMA is not liable for consequential damages due to defects or for the actions of agents and assistants.

·        Our pages contain links to other websites on the internet. The following applies to all such links: We expressly declare that we have no influence on the design and content of the linked pages. We explicitly distance ourselves from all content of all third-party linked pages and do not adopt their content as our own. This statement applies to all displayed links and all content on the pages to which the links lead.

·        The contracting party must report any damages caused by SOLUNMA’s actions in writing without delay, within five (5) business days after the occurrence and knowledge of the damage, to SOLUNMA.

9. Force Majeure

·        SOLUNMA is not liable for damages resulting from service failures or delays caused by unforeseeable events beyond the control of SOLUNMA, its legal representatives, or its agents (force majeure). Events considered force majeure include, in particular, war, unrest, natural disasters, pandemics/epidemics, fire, power outages, official orders, lawful internal company measures, as well as the failure or restriction of communication networks and gateways of other providers.

10. Severability Clause

·        If individual provisions of these Terms and Conditions (AGB) are wholly or partially invalid, this does not affect the validity of the remaining provisions. Invalid regulations are to be replaced by provisions that come closest to the original regulation in economic intent.

·        Deviations from these Terms and Conditions are only valid if agreed upon in writing.

11. Applicable Law / Jurisdiction

·        Exclusively Swiss law applies. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG), also known as the Vienna Sales Convention, are excluded. For contracts with consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

·        The exclusive place of jurisdiction is the registered office of SOLUNMA.ch or its legal successor, except in relation to consumers, in which case the place of jurisdiction is the consumer’s Swiss residence.
